Why and how are Child Custody Evaluations initiated?
When there is a disagreement between the parents or custodians of the child(ren) about who should have primary custody, the court appoints an impartial, professionally trained person to collect information, evaluate the circumstances and report their findings to the court.
What is a Child Custody Evaluation?
- The primary purpose is to determine psychologically the best interests of the child(ren).
- The evaluator will focus upon parenting attributes through multiple sources of information which may include collateral contacts, testing, and interviews. At times, home visits may also be conducted.
- The evaluator will provide equal and balanced time and attention to each party.
- The evaluation is driven by what is in the best interest of the child(ren).
How are evaluations conducted?
The evaluator will meet with you, you and the child(ren), and if appropriate, the child(ren) alone. There may also be some psychological testing, collateral contacts and home visits.
WHAT ARE THE DIFFERENT TYPES OF CHILD CUSTODY EVALUATIONS?
- Out of State Investigations (OSI)This allows the collection of Child Custody information from a party who is living in a different state or jurisdiction from where the court action is being held. The information collected is forwarded to the primary evaluator for inclusion into their Child Custody Evaluation report.
- Focused Evaluations - Brief but focused on one or two subjects only such as:
- Substance Abuse,
- Domestic Violence,
- School Issues, etc.
- Home Studies – When the only question is the living situation. Often these are conducted when one of the parties lives in a different jurisdiction than the court action.
- Full Child Custody Evaluations - This includes interviews or all parties, the children, testing and sometimes home studies. Because they are very comprehensive they will often take several months to complete.
